I talked with my lawyer yesterday, was informed that American immigration lawyers association (AILA) is filing for a class action lawsuit against DOL. There has been about 40% cases that are getting audited in Atlanta center. But after replying to queries, the center is not responding on a timely basis. There is light at the end of the tunnel.:)

So you made it...........great news......just a day back we were in the same boat and ttoday many have made it to the shore ......I really feel happy for you guys.......i know in the long run and scheme of things we spend too much time on little things.....

I'm from ATL and the latest i could get an infopass at ATL local office is on August 12th. My EAD expires Aug 22nd. I will have to ask him what to . Does anbody know if there is an interim EAD and if so, will they give it immediately or is there a "process" for that also.

texcan, it is a bit off topic but it is so funny.....
This really captures a lot of what all the "desis" do. Eat a lot of food and watch movies.
Me and my friends joke about it all the time. We try very hard to break from it but its really hard.
On a serious note I agree one should live life to the fullest but I think there is a balance.
Money is not everything but one shouldn't go bankrupt or end up in foreclosure trying to live life to the fullest.
I know those desis who are super savers and will never improve life style and I know those who are always on the edge of bankruptcy because they wanted to live the american dream.
I believe there are always two camps in any group, different view points, ideas and observations.
I firmly believe even if words are harsh from some members they donot mean that bad, or they just simply cant see other's view point.
Over last few year, i have observed something and that bothers me, the point is
"We (Indians) are interesting people, we want to live as an indian in america";
save a lot of money, go home(india) for 15 days ....say bad things about india
and then come here...start saying bad things about america.
I like some points aobut half hearted work from some fellows. I totally agree.
Here is my simply take, if we want to live and compete hapilly, we have to really live in america as an american.
How can an indian who slept all afternoon on weekend, then watched a movie and ate heavy dinnner at night with 5 indian families who all taked about negative things in america; will /can compete with american on monday morning...when this american
got up early on saturday, ran 10 miles ...full of energy....took his/her kids for camping or went on its own, ran /exercised on sunday may be a long trek in woods...he is fresh, ready to work, creative...
I donot think anyone who slept all week/watched movie/talked negative about american society /about america can compete with someone who lived for full weekend.
These are just small observations.
In short, most of us are still living an indian life in america. This will not take us far,
If we want to be happy we got to live as an american in america.
Money is not everything,a big bankbalance will do no good to anyone at age of 65 when you cant move your leg let apart run or play.

I e-filed my EAD and send documents.

Documents received by USCIS and LUD on 04/16/10

So, on and after documents were received by USCIS, I had received 3 LUDs. Is this normal? Has it happened to someone else who e-filed. Mine is at NSC.

I filed my application on the 14th as well. I had LUDs almost everyday till 4/21/10.

2)If my I 485 is approved before I file my spouse I 485, is it Okay to file I 485 for the spouse as normal case ?
No you cannot, if your case gets approved, your wife will loose H4 status.

My friend was in same situation couple of yrs ago and doctor advised not to take immunization as this will affect the pregnancy (baby). so the INS doctor mentioned this in medical form and she did the immunization after delivering baby (almost 2 yrs after filing I-485). so this is not a issue, before your I-485 approval USCIS they will send the query to put vaccination and at that time you can show that you did by showing proof of vaccination.

What exactly do they mean by electronic re-validation? Aren't all FPs stored electronically anyway? And they validate it everytime you re-enter the country or apply for EAD....

I agree that a rational middle ground can be found -- but amnesty is not the middle ground.
Instead, I will soon be introducing legislation, the Border Integrity and Immigration Reform Act. This bill is tough on border security and tough on employers who hire illegal aliens. It will include a guest worker program -- but it will not include an amnesty (nor require a huge new government bureaucracy to administer the program). I believe this legislation is a strong alternative to the amnesty plan passed by the Senate; and I hope that it will serve as an attractive alternative to my colleagues in the House of Representatives.
Since immigration reform must begin by securing our border, my plan incorporates the Border Protection, Antiterrorism and Illegal Immigration Control Act, already passed by the House, in its entirety, with only minor changes. Thus my plan will add port-of-entry inspectors, end the policy of "catch and release," put to use American technology such as unmanned aerial vehicles, require a security fence to be built across our southern border, and require the Secretary of Homeland Security to certify that all these border security measures are substantially completed before any new guest worker program would begin.
But my bill does not include a so-called path to citizenship, i.e., an amnesty, for the some 12 million illegal aliens in this country. Instead, it insists that they leave and come back legally if they have a job opportunity in the U.S. They will be allowed to do so under the terms of a guest-worker program that will be implemented by firms in the private sector, not by a new government bureaucracy.
Private worker-placement agencies -- "Ellis Island Centers" -- would be licensed by the federal government to match guest workers with jobs that employers cannot fill with American workers. These agencies will match guest workers with jobs, perform health screening, fingerprint them, and convey the appropriate information to the FBI and Homeland Security so that a background check can be performed. Once this is done, the guest worker would be provided with a visa issued by the State Department. The whole process will take a matter of one week, or less.
My immigration reform plan does not favor illegal immigrants. Anyone may apply for a guest-worker visa at the new Ellis Island Centers; indeed, the plan may actually work to the advantage of applicants who have never violated our immigration laws, since guest-worker visas will be issued only outside the U.S.
There will initially be no cap on the number of visas that can be issued; for the first three years, the market and the needs of U.S. employers will set the limit on the number of guest workers. This is necessary in order to provide the incentive for illegal aliens in this country to self-deport and come back legally. After three years, however, a reasonable limit on the number of these "W" visas will be determined by the Department of Labor, based on employment statistics, employer needs and other research.
Nevertheless, there will be a limit on the amount of time guest workers can spend in this country. They would be allowed to renew their visas, but only for a period of up to six years. Every night Americans see news images of people crossing the border illegally. They hear of people paying thousands of dollars to "coyotes" to smuggle them into the country; they worry that drugs will make their way into the hands of their children more readily. And they rightly fear that our porous borders make it more likely that terrorists will cross with deadly intentions against our families.
I believe that my Border Integrity and Immigration Reform Act is a solution that those opposed to amnesty and those who propose a guest-worker program can both support. It offers a solution that those calling for the humane treatment of illegal immigrants can embrace.

EB3 ROW is at Jun 2004. But as per latest USCIS inventory, EB3 ROW pending 485's are around 48,000. Visa numbers available every year for EB3 is approximately 42k. If you deduct the backlogged EB3 countries (4x3000) visa numbers, the total comes down to 30k for EB3 ROW. So EB3 ROW should become current or atleast Jul 07 in another 1.5 years. If this is not going to happen, it means they are diverting the EB3 numbers to some other categories.

not a bad idea. Only that those who came here on an F-1 will need to get an F4 (something like a dual-intent work visa) after graduation. those of us who came here on F-1 and worked hard for GREs and through grad school did it only because we wanted to settle down here.
See, if you had immigrant intent, the F1 should have been denied. There should be no dual intent for any work visa whether F4 or H1 or L1, period. If the worker is supposed to be in a permanent job, only option should be to get a green card. The current system has encouraged a bad habit of pretending that permanent workers are really temporary workers who would eventually go back.

I am currently in 6th year of my H1 Visa. I had applied for labor certification (Atlanta center) in Dec 2006. In May 2007 I got the denial and my attorney requested for review/appeal. In case if they deny it again, then i need to re-apply. Since i am in 6th year of H1 and if I re-apply do I get the H1 extension? Please help.

I just talk to USCIS customer rep..She said it might take beyond 90 days because of too many applications...if my case is still pending within 90 days then only i can go to local office it seems. But USCIS already took final decision on my case so i cannot go to office. But she asked me to try once by taking infopass appointment.
