I need to go to some place where I can spit out my frustration. This is just not done. Completely unfair.
With a user id that you have and your comment above :D, I think people might take you seriously. Take it easy buddy.:) I might not go to the mall today as I was planning to and stick to home.
Life has lots of other issues,so while the GC is important it cannot and should not come before all other problems in life. Talk to the people who have been diagnosed with cancer or something else and have been told that they will live 6 months at the most, you'll understand what priorities in life are.
I do wish it was Friday today then could have downed a few pegs tonight :rolleyes:

Hi folks, just as predicted, my email thread to select contacts resulted in one outright racist response. i dont want this group to get distracted or distressed if you too get such responses. take a look at the original note below and my response. remain brave. remain strong. this is a LEGAL immigration process in the US economic interest too.

I have to let you know that not only will I not support this bill, but I am vehemently against the legal immigration of workers that are originally brought here to usurp positions that would have otherwise been held by skilled Americans. I agree that this is a racist and exclusionary position, but I also know many people who can no longer get work at the level they deserve due to the displacement they have experienced as a result of this foreign worker influx.
Please remove me from any future posts regarding this or related issues.

i will not dignify your self avowed racism with the erudition of economics, capitalism, innovation, globalization, human rights or the rich history of the united states as a melting pot of cultures ... all of which are underpinning factors that are in the long term US economic interests in high skilled LEGAL immigration. of course, these tend to be conveniently ignored on the altar of superficial sentiment, myopic protectionism and deep-rooted xenophobia.
it would be best that we not be on each others' personal contacts or have any future interaction at all.
hopefully people will begin to realize that anti-legal-immigration is just a facade for deep rooted racism.

The amazing thing is We Found all the things we lost. I found the same pair of glasses Twice! The owner managed to lose it again in the situation room and I found it again - I think he didn't like the glasses :)
Chargers and ties were lost and found. I think after working 3 days straight, without much food/sleep and thousand and one things on our mind - we too were lost :)

I understand that. However, apart from canvassing the support for CIR by writing to senators, lawmakers, in what capacity can IV influence USCIS to take up EB-3 cause?
Even if IV has intentions to ameliorate our pain, is it truly capable to influence the agency to do something for only one specific category ? At a micro-level, we EB-3 need to do something about changing our situation ourselves, lest we stand in the filthy excreta for eons. :mad:
I truly believe, though IV's efforts can impact a little bit, they have to join other organizations to strengthen the efforts and results.

This rumor from fragomen's site is creating a havoc everywhere.
These rumors are wreaking havoc on people who are not in a perfect position to control the timing of filing. Many lawyers and many employers will file between 25th and 31st July. And I can accept that. My own HR and lawfirm have made it clear that we will file before 31st July but there is no guarantee that it will be sooner than that and any sooner than that is not neccesary.
Those who are filing on their own can file on July 1st. But those who are depending on lawyers and their own HR, please relax and stop thinking too much.
Never trust the FDBL assholes. They've screwed me multiple times in the past and the irony is that I've paid them for that.

Hi,
My wife needs to change her status from H4 to H1 as soon as possible (before 31st of March). Her current status is -
- H4 on passpost (expiring on 19th March)
- H4 extension approved till 2010
- She has an H1B approved till 2010 (no I94 with the approval notice as it was done when she was in India)
What are our options? These are what we know with pros/cons. Please add/correct.
1. Go for stamping to India.
This looks like the safest option as this is first time stamping. Both Mumbai and Delhi have 31st as first dates available for appt. Chennai is open but we have heard rejection rate is high. Please comment.
2. Go for stamping to Canada
She does not have a US degree and we have heard that first time stamping is difficult without it.
3. Stamping in Mexico
We have heard that first time stamping is generally not recommended.
4. Change of Status within USA
This is the easiest but will take much longer, at least 3 months or so.
Any suggestions are welcome. Please let us know as we are trying to formulate a plan so we can minimize rejection risk and get H1 stamp/COS before 31st.

Addressing concerns about fraud and abuse of the labor certification system, the Department of Labor (DOL) recently announced new regulations regarding labor certifications, including ending employers' ability to substitute alien beneficiaries, imposing a 180-day validity period of labor certifications, and regulating the payment of attorney fees associated with the filing of labor certifications. These rules will take effect on July 16, 2007.
As we have previously discussed in this column, the labor certification process is necessary for alien workers to gain lawful permanent residence through an employer for most occupations. Before the Department of Homeland Security - U.S. Citizenship and Immigration Services (USCIS) may approve employment-based immigrant visa petitions, the DOL must first certify to the USCIS that: (1) there are not sufficient U.S. workers, who are able, willing, qualified, and available at the time of the application for a visa and admission into the U.S. and at the place where the alien is to perform the work; and (2) the employment of the alien will not adversely affect the wages and working conditions of similarly employed U.S. workers.
One major change in the adjudication of labor certifications is the substitution of a beneficiary. Although not codified in law or regulation, the USCIS and DOL permits the substitution of new beneficiaries for pending or approved labor certifications to accommodate employers and their labor needs. Unfortunately, the DOL claimed that some unscrupulous lawyers and employers sold labor certifications to foreign nationals not originally identified as the beneficiary and where a bona fide job opportunity did not exist. To prevent this type of abuse in the labor certification system, the DOL will prohibit the substitution of alien beneficiaries on the rule's effective date. Previously-approved substitutions and requests for substitution! s made p rior to July 16, 2007, will remain valid.
In its new rule, the DOL will also impose a 180-day validity period for approved labor certifications. Labor certifications are presently valid for an indefinite time, but after July 16, 2007, employers must file the I-140 immigrant visa petitions with the USCIS within 180 days of the labor certification approval. Immigrant visa petitions filed after 180 days of a labor certification's approval will be denied because the labor certification will no longer be considered valid. Labor certifications approved before the rule's effective date of July 16, 2007, will also be subject to the 180-day deadline, i.e., employers will need to file I-140 visa petitions based on these prior labor certifications prior to January 12, 2008.
The DOL also clarifies in its impending rule that the barter, purchase, and sale of labor certifications is prohibited, and sets forth the ramifications for employers or attorneys engaged in this unlawful conduct, including suspension, criminal indictment, and disbarment.
The most controversial part of the DOL's new rule concerns the payment of costs and attorney fees associated with filing labor certifications. The regulations are presently silent as to whether employer or employee should bear these costs, but the new rule clearly delineates each party's financial obligations. Effective July 16, 2007, attorneys representing both the employer and alien worker in a labor certification must be paid directly by the employer for legal fees associated with preparing the application and representation before the DOL. Employers will also be responsible for paying for advertisements and related costs, which the DOL believes will help safeguard the integrity of the labor certification process. These costs cannot be transferred to or shared with the alien worker. Should the foreign national retain an attorney to represent him in the labor certification process, and this attorney will not also be representing the employer, ! the fore ign national will be allowed to pay fees directly to the attorney. This particular rule may be challenged by various immigration attorneys through litigation for interfering with contractual relationships between an attorney and a client.
Obtaining a labor certification from the DOL entails complex issues legally and procedurally for both the employer and foreign national seeking resident status. Employers and individuals seeking legal representation in these matters should consult experienced immigration counsel.

This is true. I heared the same from my attorney too. If you look at the history, there are two times they have discontinued the VB in the middle of the month. So let us hope the best and we will prepare for the worst.
I am not sure how far it is true, but this is the content of the email I got from my attorney when I pressed him to file at the earlierst.
"As soon as we have these forms back, all of the evidence for filing remaining from you, and I review the completed filing, we will file it. We appreciate your interest in filing on the first day the filing allows. We will endeavor to do that. I should point out that the current bulletin allows for filings throughout July. It is possible that the filings could be discontinued later in July. We are in touch with officials in Washington about this issue and will file your application in a timely fashion for obtaining the benefit when the filing is properly prepared."

my wife filed on may 29th, soft lud on june 6th and fp done on june 21st. no updates/luds after the one on june 6th.
my wife called them last friday and opened a SR.. we'll see if that helps.. i think we will go ahead and schedule infopass as well..

I got the CPO email just now.. i'm not sure if it's because of the SR that my wife opened on Friday evening or it just happened without that.. but anyways it's a relief now.. i also see a lot of people getting cpo emails today.. btw, just curious, does the cpo stage come before "approved" status or after it?

Please enlighten me - the one who proposed this idea and for those who supported this - Why do you think the concerned authorities or lawmakers would listen to you (us) and agree to making this happen? I believe Green Card gives us all the priviliges of the US citizenship except the voting rights. Besides the voting right, what are the significant differences between the two (Green Card vs. Citizenship) that would make a good case for asking for a faster citizenship program?
GC is an extension of H1B issued for 10 years and gives freedom to change the employer. Citizenship is different and do not compare GC with Citizenship.
