AMY GOODMAN: But let me give you one more clip, and that is around the issue of the Minutemen.

    LOU DOBBS: Sure.

AMY GOODMAN: This was the Minuteman Project, organizers calling their effort a peaceful protest over the governments failure to secure its borders. Both the Mexican government and the Bush administration have described the Minutemen as vigilantes. You have been a vocal supporter.

LOU DOBBS: I just want to be clear to the Journal and to this audience: I support the Minuteman Project and the fine Americans who make it up and all theyve accomplished, fully, relentlessly and proudly.

    AMY GOODMAN: Thats you, Lou.

    LOU DOBBS: Thats me.

AMY GOODMAN: Bill Parmley, a Minuteman leader in Goliad County in Texas, quit the group because of, what he described, widespread racism. Another Texas Minuteman, Janet Ahrens, had resigned because members, she said, wanted to shoot the taco meat. You never mentioned either of these people. Why not talk about these people quitting, because theyre concerned about how racist this group is?

LOU DOBBS: Well, frankly, I didnt know about it. I don think itswhat makes them so newsworthy? And secondly, the reality is, the President called the Minutemen vigilantes immediately after they were formed. The idea that I would support volunteerism and the nature of the call to security on the border, I hope, doesnt stun you too much, because the reality, again, is that there has never been an incident of violence involving the Minuteman organization, period. Do you want to take note of that?

AMY GOODMAN: Are you concerned with, among others, one of the founders of the Minutemen being found with a gun, patrolling the border; issues like these? This is of concern, when there are so many immigrants who are found in the desert dead, not clear why they die.

LOU DOBBS: Oh, are you implying that the Minutemen are killing them?

    AMY GOODMAN: No. But just

LOU DOBBS: Then why would you say such a thing?

    AMY GOODMAN: My question is

LOU DOBBS: Thats terrible, Amy. I mean, good Lord!

AMY GOODMAN: My question is, when

LOU DOBBS: Lets answer one question: has there ever been a single incident of violence recorded on the part of the Minutemen on the border?

    AMY GOODMAN: I believewasnt there

LOU DOBBS: There has never been.

AMY GOODMAN: Im nothavent there been cases of immigrants who come over the border, who have been chased, who have been shot at, who have been beaten?

LOU DOBBS: That would be an incident of violence. That would be an incident of violence, wouldnt it? To my knowledge, there has never been an incident of violence on the part of the Minutemen.

AMY GOODMAN: But the idea of armed men on the border

    LOU DOBBS: Oh, come on!

AMY GOODMAN: not authorized by the United States?

LOU DOBBS: Does it bother you that there are armed drug cartel members firing on law enforcement officers on the border, killing Mexican citizens, US citizens?

    JUAN GONZALEZ: Absolutely.

LOU DOBBS: Does any of this bother you?

    JUAN GONZALEZ: Absolutely does, yes.

LOU DOBBS: I would hope to heck it bothers you. Why would the Minutemen even be under discussion by comparison to that issue?

Thanks for everybody's support and good suggestions. I feel that even if there is no immigration related legislation due to this forum, the enormous amount of knowledge that has been accumulated due to contributions from everybody is a tremendous resource in itself. No more guessing what to answer to a confusing question on I 765 or I 131. Just do a google search and more often than not, a thread from IV will be the top on the list (and it usually contains useful info)! That itself is a great achievment. So thanks everybody and specially to IV core for keeping this effor going on. Hope we will have some meaningful legislative reforms soon. However I feel that it's good to remember that GC is like money- it's value stems from it's scarcity :-)

    Bharatpremi,

Thanks for the excellent analysis. One question, your analysis assumes category excess visas goto next category on a per country basis, is this correct ?

Ans: Yes. In reality nobody is sure how USCIS is spilling over, vertical way, the way which I have assumed here OR horizontal way as per your belief OR combination of both.
Example, EB-1 china number goto EB-2 China ? I thought all EB-1 China numbers are added to the excess pool and then given to most retrogressed EB2 category ?

Thanks for anyone who clarifies this.

No matter how the data is sliced and diced, being EB3-I certainly means a loo...ong wait time ... :) yes , agreed. No matter how you slice or dice, EB3-I is and will always be "Sautan Ke Chhore" (Step Sons/daughters):)

Vonage's cancellation early termination charge is $39.99 + Some admin charges = $45.

The $100 you are talking about is when you sign up and also ask for the router from vonage. what I did was went to craigslist and bought the vonage router for $15 and signed up for vonage. They sent the cancellation policy and charges by email which is somewhere between $40-$45.

I was earlier their customer when moved from vonage to T-mobile @Home. After a little argument they waived off the early termination charges and now because of the good customer service I joined them back. As by joining I got a free month of phone service as well.
I would say the reps on the other side also human being and depends on how one goes on to put up their point in the most polite manner without hurting anyone or anything in the process and results are always fruitful if the conversations are driven the right way.

Overall for me to make calls and recieve calls without any hassle is the key and I think vonage is pretty good at it. Moreover they moved their customer care I think moved back in US from phillipines as this time the conversation was smooth and didn't have to repeat the sentence again or didn't have to ask to say again.

Also I don't care if any competitor comes up with a $2 less + some more feature. Quality is the key and I think vonage beats everyone in that. I had a tough time fixing up my fax machine wiht sun rocket once upon a time and cancelled my service with them for that reason.

Vonage has a contract of 1 year. Have to pay around $100 if you break the contract.

Lingo has a contract for 2 years. Will have to pay a similar contract break fee for Lingo as well.

Monthly charges for world plan: Lingo is cheaper than vonage
Voice quality: Vonage is slightly better than Lingo. Lingo is ok too.
Customer service: Vonage is better than Lingo
Contract Period: Vonage 1 year. Lingo 2 years
Plan selections: Lingo has more plan selections.
Cheapest plan: Lingo $7.95/month for 250 minutes america plan. Vonage $17.99/month for 500 minutes US plan

This is approx data from last year DOS yearly report.

    EB1 = 41k
    EB2 = 53k
    EB3 = 42k
    EB4 = 11k
    EB5 = 2k

    Total was ~ 150 k ( 140k + 10 K from Family Quota's Spill over )

so basically EB1 and EB2 row didn't give any spill over , it was EB5 and family based spill over.
This year we will not get family but instead EB1 will give same share so in the end total spill over for year will not be more than 20-22k.

This data shows EB2 ROW indeed gave a lot spillover. Total EB2 was 53K out of which India was 19961 and China 6505. Which means around 27 K was used by ROW. So , balance of ROW was added to spill over

    Hi All,
I received the CPO email yesterday. My case details are PD : Dec 2004, 485 RD : Aug 6th 2007(I140 Filed concurrently),EB2 India.140 was approved on Tuesday.

I140 was pending from 2007.When my attorney followed up in feb this year,USCIS gave the standard reply of waiting for 6months.After that they said, they will update in 10 days. They didn't update even after that and then i moved it to premium processing on Sept 28th.

Took 2 info passes in Septembter(regd i140 mainly).First one was not of much help though the officer told my 485 is assigned to IO on Sept 8th.Second time it was different officer and she was very helpful.Tried looking why my 140 is getting delayed but she said ,if she opens my file then 485 file will go back to review queue as it is currently being reviewed by Sept 18th.So she didn't recommend doing that.I didn't open any SR after my first experience of 6 months waiting(without an result!!!)

Before 485 approval day(i.e Tuesday) i called IO TSC Center but he doesn't know anything when i mentioned that my PD is Dec 2004 & that my case is current from last month.,he told my PD is the RD of 485.I thought no point in arguing with him and hung up.After that i was preparing to send mails to Senator but got the approval before that.

Anyway, happy that it finally got approved .I am waiting on my wife's approval thought

We can get all his transcripts here

    http://transcripts.cnn.com/TRANSCRIPTS/ldt.html

Just do a search of h1 and you will know when has he discussed h1b

I just picked the first one and i'm freaking mad already, comments in red below
    http://transcripts.cnn.com/TRANSCRIPTS/0706/25/ldt.01.html

    ------------------------------------------
(COMMERCIAL BREAK) DOBBS: The Senate's grand compromise could dramatically increase the number of H1-B visas from 65,000 to 180,000. It would also expand the number of exemptions to those limits. It's a bill that favors, by a wide margin, corporate America and further -- further disadvantages American workers.

    Bill Tucker has our report.

    (BEGIN VIDEOTAPE)

BILL TUCKER, CNN CORRESPONDENT (voice-over): All H1-B visa workers do not look like this. Some even look like this. Most do work at technology companies, based on the latest data available from the government, data which is incomplete but revealing, nonetheless.

Five of the top six employers of H1-B visa workers in 2006 were Indian companies. They were issued 18,453 visas. In total, almost 20,000 visas issued in 2006 went to Indian outsourcing companies, and the data shows it was not American workers who benefited but foreign workers.

JOHN MIANO, ATTORNEY: According to the Bureau of Labor Statistics, between 2000 and 2005, the United States' employment for computer workers grew by about 332,000.

During the same time period, the United States imported about 330,000 H1-B workers for computer occupations.

TUCKER: The situation for engineers was even worse, with 95,000 H1-B visas issued in the same period for engineering, yet according to the Department of Labor, engineering jobs shrank by almost 124,000 jobs.

The visa is often referred to as being for the brightest and the best. But, the visa is broken up into four levels of classifications, with levels 1 and 2 being the lowest-skilled positions, and 87 percent of the visas went to those categories. WTF is he talking about 1 and 2? how can bachelors required masters required be lowest skilled positions?

RON HIRA, ROCHESTER INSTITUTE OF TECHNOLOGY: We really don't know whether those workers are working at level one. We know that they're being paid level one wages.

And what's interesting, at level one is if you look at the description of it, it's basically for interns, for people who have zero experience. From what I know H1 cannot be granted with Zero experience Am i missing something????

TUCKER: No one knows how many H1-B workers there are currently in the country or where they are. Each and every one is traceable based on employers address, again fudging the facts

DOBBS: ... have gone by before providing even the summary information.

But to just put this in some perspective, what we're really reporting here is that the H1-B visa program, which by the way, we should point out Bill Gates, the world's wealthiest man, who is not exactly without a stake in this issue, sat before Senator Kennedy in a one-man hearing and said he wants unlimited visas.

The fact is we don't know who has the visas. you know that there are 330k visa issued, this itself means that USCIS knows who has the visas
We do know that Indian companies who are outsourcing the -- to American companies rather than providing the American jobs are the principle beneficiaries of those, and that most of those jobs are low-skill jobs, are being paid at intern levels.Again fudging the facts, everyone has to be paid prevailing wages

I guess we should say in the case of category one. How in the world can the United States Congress, with this information in front of all of us, sit there or stand there on the Senate floor with straight faces and talk about this issue without any basis for their positions?

TUCKER: I guess they're just blinded by the corporate donations, Lou. Money from the high-tech companies is the only answer I can think of.

DOBBS: The American worker. And where is AFL-CIO? Where in the world are all the labor organizations in this country, who should be standing up and demanding that the American worker not lose his and her rights that have been so hard fought for and won over the course of the past century? It is mind-boggling to me.His final notes or propaganda after fudging the facts to provoke and anger citizens who just saw the bs report

Bill Tucker, thank you very much.

And we'll continue to put the facts before not only this audience but even the recalcitrant legislators who represent us all in Washington, D.C.

For senator and congres(wo)man it is really simple call your local senator or congres(wo)man or got to their website and fill out a privacy form and send it to the person handling immigration service at their office. As a part of that form explain them your situation and what you want their office to do for you. They will promptly follow up with USCIS on your behalf and will provide you with regular update as and when they get it from USCIS. You can easily find your local senator or congres(wo)man on google search.

Thanks very much for your help and congratulations on getting your approval.

    Best.

all other documents for status are available
    how important is that card?
any way to get a duplicate/copy??

you might be able to get a duplicate by contacting the college/university.

my case is somewhat similar, but I dont have that option: I was on L2-EAD and I cannot find that damn EAD card (needed for filing EAD based on I485). However I do have the older I-797 so can atleast prove status...

    Hi Shweta:

First, don't panic :) I doubt there's anything we can do about it at this stage. I'm in exactly the same situation (interview at the Delhi consulate on the 22nd, response - administrative processing, and the consular officer had told me that I'd get it in a week).

According to my lawyer, our cases have been sent to Washington for security clearence. And based on the feedback she has been getting, it is taking about a month. The embassy cannot issue our visas till they hear back from Washington.

So I realize that it totally _SUX_ but there's nothing we can do about it. So just chill and wait..

    s

    bepositive,

in my case i got no slip..whenever i call consulate new delhi they say still under admin processing ?? my lawyer checked with DOS..DOS had sent approval on jan 25th..still under proc at embassy !!

NOT SURE WHY ?? this delay is ??

i maybe forgetting..but which consulate did you go to and if new delhi then what was the description(looks) of the VO ?

I was just wondering if anybody knows about Science & Technology Related VISA Issuance Delay at Indian consulates and embassy. Is it a new thing introdcuced recently? Now they require you to fill up a 6-pages long questionnaire and wait 2-3 weeks delay. Anybody on h1-B has gone through this?

    Look at this link:

    http://newdelhi.usembassy.gov/applyinghlopq.html

    Then go here-----

When you apply for a visa

    A. Apply early for a visa. You should apply as soon as you have an approved petition, as indicated by receipt of a Form I-797, Notice of Approval

    B. If you plan to engage in technology-related business or research while in the U.S., a set of specific documents should accompany your visa application. Your application also may require additional administrative processing. For more details, click here. When you click here you see this --

    Nonimmigrant Visas

Visa Applicants Planning to Engage in Technology-Related Business or Study While in the United States:

If you are involved in technical or scientific fields, your visa application may require administrative processing of approximately two to three weeks. If you think this requirement will affect you, apply for your visa as early as possible, prepare for your visa interview well in advance and bring to your visa interview the following documents:

A completed and printed questionnaire: Questionnaire (PDF: 37k*)
A copy of your resume or curriculum vitae (CV)
A list of your publications (if any)
A summary of your past research
A detailed description of your ongoing or future research or work in the U.S.
The name of your advisor or sponsor in the U.S., including a mailing address and telephone number
The name of the financial sponsor of the U.S. study/research
    A list of references

    Further Instructions & Information:

All documentation must be in English
You should be ready to answer specific questions during the visa interview about your research plans in the U.S.
If you do not bring complete information to your visa interview, for example, a completed questionnaire, your resume and research summary, you may have your application delayed even further, or may be refused a visa and be required to apply again
As soon as the processing of your visa is complete, the Visa Section will contact you and explain how you can pick up the visa. You do not need to contact the Visa Section, make a new appointment or pay the Visa Application Fee again

Anybody on h1-B has gone through this?

I am very sorry to hear this. It should be a rare case that you have got 221g after your visa has been approved by visa officer.

Approach the consulate with your email, and they might give you a questionnaire to fill up. It must be regarding some additional documents being required.

Dont worry, you will come through!

Supply and Demand. (and its affect on pricing)
    Cyclic Nature of Real Estate

The same reason why mine and your 401K is 100K lower than what is was in Oct last year. The same reason why Intel will be selling fewer chips, why people will not drink as many grande latte at Starfucks as they did last year and ....

This is not the first time.

Yes, I do agree that we should have some sense of personal responsibility and that is why the middle way is to rent out the house (probably at a bit lower price than your monthly mortgage) and pay the difference from your pocket - if you have to absolutely move out from the house. But, can somebody answer my question above..........why is the same house (not even a brick changed) being appraised at around 100k lower than it was done 2 years back, by the same bank??
