53,872 ( EB2 Total allocation in 2010 ) = Some X (EB2 ROW usage is say X) + 19,961 ( Total India received in 2010) + 6,505( Total China's received in 2010)

The average demand for EB2 India is about 1.5k/Month.
which takes 3*1.5 = 4.5 K visas.

The Total demand for EB2 India & China together from Aug 2006 will be about 2.2k/Month.

Hello, I can understand your pain as I was in a similar situation as you are. I would recommend to wait for atleast 2 weeks. I interviewed on 28th Dec and finally got the email on 9th Jan and the pp stamped on 10th Jan and took the flight on 12th Jan.
If you have an upcoming travel which is in next week, please try to reschedule it as it is not certain on how much time does it take in such cases.
I do not think getting the employer involved into this will help. VFS office will have no clue on this and they will answer only Questions on the process. Writing to the US consulate will also give you a general answer. It is sad that there is no accountability in cases like these. Please keep the faith.

Like others have pointed out, it looks like that the numbers are being allocated in a different way from before. Does any one know of any article or discussion by a real attorney or some expert on what is going on?

At this rate EB3 will crawl to death. People will try to jump into EB2 and realignments/adjustments automatically will take place.All good for USCIS.

What should be the answer to this question on I-485 part 2- out of following 2 options for my dependents ? to me it seems #b is the right answer for my family members 485 and #a for me. BUt some how teh legal guys are changing this from #b to #a for my dependents!!

They should have your info unless consulate hasn't sent it. they use your passport number as reference. so call again if they didn't use your passport number to search. in any case ping the consulate again.

Actually this time I asked my friend in US to call DOS, and he used the computerized answering system with my petition number and they did say that my H1-B petition has been approved. I don't know if I mispronounced/mistyped anything when I did it last week, but at least now I'm sure that it is on DOS' system. Thats the same thing I heard when I called KCC, that my petition was approved in April 2007. Or maybe I should've asked them if they've access to PIMS. It's frustrating man, I never thought at this stage of career, entry-level that is, I will be stalled by things like this. Well I hope in the end I can find a rational explanation to why things turned out the way they did.
For the new folks in the forum, its been 75 days and am still waiting for my H1 visa. I guess I should also talk to that Mexican Emabassy and see if my case shows up on the PIMS or not. The only problem with New Delhi embassy is that when I call them, all they say is that the case is still pending, and nothing else. I don't even know if I should curse them for being incompetent, or maybe that is all their job entails (I'm not being condescending here). Is it advisable for me to go to New Delhi personally? This is a mess, but as long as its in God's design, I'm ok with it. I just don't wanna feel later that if I had done this ... blah blah, then I could've expedited the whole stuff. That'd be a bummer. I had already mentioned my EAD status when they had the interview. But after acceptiing it I mentioned it again in the conext of I9 form. Then they said they cant offer me emp;oyment due to my being on EAD.
This is a pretty big company. I understand that H1B is not protected under anti-discrimination for employment, but EAD holders, specifically those with AOS pending, are a protected against employment discrimination.
Does anyone have any links to the above conclusion ? I am so tired of this BS. I have spent long enough in this immigration c**p that if I have leave, might as well leave with a fight.

OK, unless you never initiated the EAD conversation, technically they are supposed to ask ONLY if you are legally authorized to work in the US or you need sponsership. At the time of joining, they are supposed to give you the i-9 form and you have 72 hours to return the form back with your documentation to prove that you can work for any employer. A valid EAD with a future expiration is very much a valid document and must be acccepted as a valid.

I would say, they are very competent now and we should appreciate their work, pre-adjudicate, publish demand data (DOS), inventory data (CIS) processing time (DOS). THEY know, from PERM, I-140, there are at least 2K demand permonth from EB2 I/C. SO they will just safely move a couple of month of PD to make sure there is demand >2800 for India/China, so they don't have to make it CURRENT (per law)
If it is the law that they need to make it current, then if they don't, they are opening themselves to a strong possibility of a class-action lawsuit.

I heard some one telling me that there is a max limit of 5000 mts per month which includes local, long distance and international.

As per my phone and chat conversation with Vonage is that it's a rumor, there is no limit at all, you can call as long as you want....

Ok check it on theextreme bottom part of your I-140 approval notice.. which shd say approved from TSC/NSC/VSC.. see if you see A number there.. if not I will tell you the alternate method

Can someone please post the steps to open an SR and get an Infopass? I may have a biometrics appointment coming up soon. Can they help with application status questions?

Biometrics has no questions to answer. Just follow their instructions at the center.
To create SR,
Call the toll free number and select some options for you to reach a live representative.
Tell them that you are waiting for a very long time and needs update.
You need to have your receipt notice with you. And your wife too (matters only if you are married, just for the sake of it, do not bring in anyone else's wife...just kidding)
If your wife is not with you, they will create the SR for her. Hence suggested. Take down the name of Rep and the confirmation number.
That's it.
