I think most important things you need to consider: (Considering the fact that PD will be pushed back to stone ages in September Bulletin)

    a) Hope that your I-485 Application is not approved before your PD becomes current. If this happens, it's a royal screw up until your wife keep's her own status (F1, H1).

    b) Earlier, it was predicatable when your PD would become current and it allowed most of the folks to add their spouses at later time.

    c) Bigger question is whether they would process on the basis of PD or RD. I think it's unfair to do it on basis of RD as most of the people would be jumping lines. Currently it's done on the basis of RD, but USCIS might change their SOP because of this July VB Fiasco.

    d) As others suggested, make sure to maintain your H1B status as long as possible without invoking your EAD. This way, you can continue to keep your wife on H4 status (Unless she can keep her own status for atleast another 2-3 years).

I am in the same boat with EB-2 PD of Aug 2005. My spouse is outside US to get her F1-H1B stamping as her OPT Expired few weeks back.

Hope, USCIS would allow filing for dependents at a later stage even your PD is not current.

    a) That is what I am hoping. If not, I am screwed. I planned to go ahead apply for I-485.

    b) ??? :(

    c) If USCIS doesn't go by PD, everybody is screwed....

    d) as long as possible --- What does this mean? I have to keep on extending my H1B , that's all , right. Or while coming back from India, will the Immigration officer force you to start using EAD?

    Comments would be appreciated.

    Thankyou,
    gc101.

It seems like e-file applications are getting approved faster because these 14, 25 days are not matching with current I-131 processing times shown in the webpage.

I would strongly suggest, people refrain from using words like injustice, etc., Injustice implies the US govt is doing something wrong, when they are not. Such accusations do not reflect well on us and are unlikely to benefit in any meaningful way.

Desis are impacted because we are just so many of us. No other reason. Keep in mind that we are still walking away with the bulk of green cards each year, far above the stipulated Quota.

The Green card system exists for the benefit of America. It will not be tailored to meet the individual needs of overpopulated countries. All we can do is request them to improve the system and make it easier for applicants. Taking the aggressive approach of accusations, demanding for change, asking for more, etc., will not work.

Agree with you! I faintly remember a reputed attorney filing a suit against INS a couple of years back against protracted GC on behalf of the GC community. It was rejected outright.

Should we run another targeted phone campaign to the Republican Senators (the 11 that supported previous CIR)? IV team, let us know

IV Team, a campaign has been let loose by numbersusa. It would be wise to for us to act too IMHO

How about contacting other already established organisations like ATA, TANA, DTA,BATA, Kannada kutami etc for help? All these organisations are formed by immigrant people from different states in India. They have a huge membership. We can rise funds and memberships by highlighting and explaining our problems. Is there any one pager or document that can be sent to all these orgs and asking them for help in funding as well as political drives?

It is very unfortunate that people equate job opportunities to the population of the country. If that were the case then India and China would have the most job opportunities in the world because they account for one third of the world population but that's not really the case otherwise we all wouldn't be here in the first place.

Opportunities are defined and provided by the economy. When you compare Canada to US, you might say that it's a smaller economy but remember Canada is a G8 country with such a strong economy that most other countries in the world can only dream of. US is the richest country in the world with the strongest economy so obviously other countries don't offer quite the same opportunities but Canada offers things that has become a dream for many of us... to be a citizen of the country where to permanently reside. Canada offers stability, certainty, hope for the future, and and an opportunity for everyone in your family to realilze their dreams as opposed to sitting at home for years doing nothing hoping that one day that EAD will come. Canada respects immigrants and welcomes them with an open arm quite contrary to policies in US where you are allowed to work but your family is not and even you are kept on the state of limbo for years and years wondering what your future holds in years to come. And better yet, you abide by the laws, pay taxes, do everything by the book yet the guy who just walked across the border has much better chances of becoming a permanent resident than you. Where is the respect and fairness for law abiding folks? That my friend is what is different with Canada. You get treated with respect and dignity and you get to decide what your future holds and not the US government.

    Good Luck to you all.

Why don't you start a similar forum for "going back to India" ? I hate to burst your "bubble of hope" but Canadian population and job market is limited and the opportunities for professionals like us are limited. Why not consider going back to India and taking up some of the lucrative opportunities in middle management in the IT industry.

I thought i wouldn't marry till i get ma GC coz i didn't wanna gal to come n rot here without a job being on H4.
but now i've gotten so freakin old waitin for the GC n still waitin that i might not get a gal to marry.
If you marry a girl after geting greencard you have to wait 5 years to bring her to US. So better yet, marry after you get citizenship :D which might be when you are ready to collect your social security

Shoplifting!!!! ... what the heck were u thinking? oh boy what a disgrace.

Alright, enough of beating you down. Now if your crime was adjudged civil infraction, I won't worry too much about it. Civil infractions are leinennt, but you are now all set for rest of your life to be in public records. Future employers and creditors would see that too when they do background checks. Other than that you got nothing to worry about. Go ahead and continue to plan for your India visit. But may I advise not to indulge into that habit of shoplifting? ... uhmm I know gifts can be very expensive.

I read from a different post that you can file for AOS if you are out of status for less than 180 days. there is a section 245(k) which allows you to do this. I don't know the accuracy of this info.

Consult an immigration attorney or call USCIS. This info might be outdated.

Citizenship is going to happen only after 5 years . But by then it would be long time gone .

the only way that they could find out would be based on your tax return.DO they really scrutinize to that extent?
