    Thank you for all quick replies.

    It's been about an year the case has been closed. I can't expunge it for 4 more years. The attorney said it may not be under CMT. I think even though we expunge it, in future where ever we go, if asked that ever got arrested, we need to say YES right?

    My attorney says it should be OK.. I am not sure what to be done as you said it all depends on the VO

    I am praying god for the silly thing have done and help me in this..

    Never repeat a mistake again...

    When the VO asks, you would be pretty much justifying why you are "not inadmissible"

    Just write down the facts that support your case, and have documents ready (like court disposition, may be a written statement from immigration criminal attorney that your conviction doesnot render you inadmissible).

    While i don't know whether you did intentionally, but certain silly things like this can change somebody's life forever. I hope other wouldbe immigrants learn lesson without actually having to go through this personally.

    While i have no vested interests, but money to immigration attorney is worth for such things.

    Probably your lawyer is correct that you cannot take advantage of family leave (maternity act) with less number of employees in the company than required for that.

    From what I understand about H1-B, you CAN take leave without pay - no problem with that...as long as you are on your company payroll i.e. your employement is not terminated.

    Does any of you know what rights for maternity leave has a pregnant H1B visa holder? I want to stay home next year for 3 months to take care of my baby, then start working again.
    From what I know I can only have the 6 weeks of short term disability.
    The Maternity Act does not apply in my case because the company I'm working for has under 50 employees.
    I asked my lawyer if I can take any unpaid leave without loosing my H1B status and her answer was that I can change my visa to H4 or become a part time employee for a while. I do not like any of this options because I'm in my I140 stage with my green card and I do not want to lose it at this stage, after waiting for years to get my labor cert approval.
    Your answer would be appreciated.

    I got a FP notice for next month. It is certainly not related to AP or EAD renewal, since I don't have any pending AP or EAD renewal. I got my EAD renewed last March and AP in May. So hoping that I got the FP notice since they started looking at my 485 application and something positive will be end result.

    That IO must be a knucklehead who just hates "Specific type of people" or someone who does know the f** he is doing. I have entered using AP at Boston. San fran, Seattle and never had problems. Only once they asked me for EAD/a valid H1 petition and that was just a question.

    The election results are ultimately good for us and our prospects for immigration reform in the new year. Despite the best efforts of our friends on the other side of this issue, immigration did not become a major issue in this election. No candidate won or lost because of their position on immigration alone. This is partially due to the fact that the president has recently signed the bill to build a wall on the southern border. With such a clear, physical, image of immigration enforcement in place, no reasonable candidate could ask for a more strict immigration law.

    The president has argues for CIR since his campaign in 2000. We know that our specific issues have strong support amongst both parties as evidenced by the fact that many or our requests were placed in the Senate immigration bill and passed without debate.

    At this point, The President and Congress will want to pass any laws that they can agree on - particularly if both sides can claim it as a victory for their core values.

    Nancy Pelosi is my representative here in San Francisco and I have spoken with her immigration field reps. a number of times. From my discussion, my impression was that immigration reform is something that Rep. Pelosi wants to work for. She is less aware of our specific issues than she should be. This is something that we need to work to change in the short term.
    I'm feeling hopeful and energized after the election - here's hoping for a positive start in the new year!!

    IMO, we all are in the same path, some ahead of others, but basically belong to the same larger SET. Some of us have faced the problems that students are facing now, and in all likelihood these students will face the same problems that we are facing now. More personally though, I always think, if only I knew more about the GC process back when I was in school( 12 years ago), I'd have been much better now.

    If we start digging a well every time we are thirsty it takes forever to get anything done. To give a 4 letter word why students must participate-(not what you think, dirty minds:)) STEM

    Nurses are part of EB. This nill has many benefits. More nurses will be out of greencard queue leaving others more chance. US has acute nurses shortage. It is well documented. There is not much shortage of IT professionals . Unemployment is so high. But nurses are in demand and it is important for the healthcare of the nation. Supporting the bill is a win win for everyone in EB wait.

    Really? Nurses are part of EB?? I was not aware of that. Which catagory EB3? EB2? Just curious. Either way i dont think the president is going to support this one.

    The way USCIS functions, I would rather see the movement of the dates back rather than forward...why?

    This is the time when USCIS actually TRIES to follow FIFO: meaning tries to work on old cases. Last quarter is usually a mess and approval pattern goes to TB to BB (top of the box to bottom of the box).

    So, It is a actually a good thing, if PD stays there or moves back; that will make USCIS work on approving older cases at this time.

    It is also a good sign that DOS mentioned that "they are waiting from USCIS for pending numbers": that means, they actually asked for those!!!!!! AND USCIS is working on it (or atleast told them so). This has been the crux of all the visa number movements including random approvals. If this is sorted out somehow, it will be a great deal of improvement in implementing FIFO system to some extent. If USCIS gives that info to DOS, there will be someone (DOS) to ask USCIS: WHY DO YOU NEED TO MOVE PD FORWARD TO 2008 WHILE YOU HAVE SO MANY THOUSANDS OF CASES FROM 2000-2005 PENDING??

    Unfortunately, they now will not have any excuses (with security check and name check moving towards "current": thanks to FBI), they WILL have to increase their efficiency in processing the cases!:)

    Thanks for inputs in the forums.

    EB3-India cannot be discriminated.
    Anyone in EB3 after 2-3 years waiting is qualified under EB2-I. And we see people waiting for much more. How can we be discriminated then. We have to do something.

    We are able to get very good number of people with like minds in Edison, NJ and other big cities with big concentration. We are planning to start a drive against this discrimination, in about 2-3 weeks from now. We would like to write to the honorable policitians and processing centers like Texas and others and to USCIS to treat all fairly.

    1. EB3 India cannot be treated unfairly, wheras EB3-China is much ahead. Why is this.
    2. EB2-India is Feb 2004, wheras EB3 India is Nov 2001 for many years. Why is this.
    3. Why are allowing family immigration when skilled immigrants are waiting.
    4. Why should greencards be counted head-wise, whereas H visas are not.
    5. On the whole, why backlogs and punishing us.

    These are the lines in which our group plan to drive this.,send more ideas.

    For this we need money and more impo'ly efforts, so please contribute smartly as we request below.
    We have teams in all major software hubs like NJ, DC, Livermore, CA, TX, Detroit, and and will need volunteers. We will soon come up with a yahoogroup to communicate.

    We plan to send 10,000 letters and other awareness programs letters to the concerned people.
    We plan to have our small booths in temples where many people will come.
    We will print all the letters, you just need to buy the stamp from us and mail it.
    Or give us an envelope with the 42c stamp. We need about 5-10 from you all.. So its will be $5.00 per head. That way there will be no quesiton of transparency. But if you want to donate more, you are welcome, instead we will prefer you put your efforts in creating strenghr and pass the word.
    We cannot keep quite like this. There is no reason why EB3-India will move forward in current situations and with current rules.
    We know EB2 will be upset, but based on your contribution, we can fight together, else we will go alone. EB3 is big enough to go by itself.

    We plan to wear white dress with white caps.. for peace.. So we can be easily spotted. Give us a envelopes and stamps.. or we will give you addresses to send and the document.. As you wish...Or buy the stamps from us and take the printed content from us in free envelopes.

    If I could hire IV by paying some money and then forget about it, i would do that. However, as far as I know, IV core is composed of regular folks who are also on visas and therefore can only work during their spare time/vaccation time. I know every one of us is impatient with this EB process, but the reality is our movment is not big/strong enough. Most of us once we get hold of the Green card (is it really green color??) completely forget that we were once part of an everlasting que with so many desperate people.
    This is the main difference between EB community and the ilegals. Ilegals are united by a lot of factors and even their legal relatives dont think twice before struggling/fighting for them. How many of our dear Indian/chinese friends (who are citizens of this nation) will stand up for us??? Even though many came here and strugled to obtain the EB green card, now we are alien to them!!!
    Consider the ilegal people:-
    theoratically, they are not supposed to have any voice in this nation simply because they are ilegals and hiding from the law. How come then that they are able to have such a huge protest march?? because most of the people who protested for them and stand up for them are legals
    We will be 100 times more successful if the major indian associations/chinese associations or other country associations raise the voice for us. They should "BECOME HUMAN BEINGS ONCE AGAIN" and feel for us. We should remind them once again of the strange and long path many of them went through to get the GC.
    HOW COME THEY IGNORE US???? IF THEY IGNORE US, WHO WILL CONSIDER US???
    IV??? my friends IV core member is a person of leadership quality for sure, but he/she is just in the same unstable boat as me and you.
    WE DESPERATELY NEED FOLKS IN THE MAIN LAND TO REACH OUT TO US.
    you have answered your own question.......the way the demographics are today - there are many families which are part legal and part illegal in terms of their immigration status - the motivation there is to bring close relatives (and even immediate family members) over to the legal side.......

    in case of EB - typically (barring some technical exceptions) the immediate family gets the GC at the same time - so the immediate family situation is not critical. If these people want to bring in their families - then thats FB immigration and not EB.

    Besides, FB immigration and to a large extent "illegal to legal" (whenever that happens) is a template driven process (if you meeting certain basic guidelines and do not have any criminal background etc - you are in - it is not upto the discretion of an immigration officer to reject a citizen's wife or father or mother on a case by case basis) - whereas EB is a fairly case by case evaluation process........hence its simpler to coin a message that resonates with the vast majority of the interested population on the non-EB side vs on the EB side (whats good for Indians may not be good for RoW and whats good for EB2 may not be good for EB3, direct employees vs consultants, 3 year degrees vs 4 year degrees, foreign degrees vs US degreess, STEM vs non STEM etc)........

    You tend to think like a group and root for the group when you suffer as a group........as much as many people on this forum would like to highlight otherwise - i think every EB story is different, every situation is different, even the extent of suffering and inconvenience is different and hence there is no "group feeling" - we are not a "herd" and hence do not act like an "herd".......

    To be brutally honest, I have had my GC for two years now, have not really had to wait for a long time either nor is the IV agenda really relevant for me (IV does not really focus on EB1) - i continue to visit the site to keep myself updated because I am concerned (as a well wisher not as an activist) and would like my friends to get their GCs asap! But, among the 100 other "human being like activies" that keep me busy (keeping my job, paying my bills, cleaning the house on weekends, not gaining any more weight with middle age approaching etc.) - do i have time to actually do something (beyond the faxes etc that we sometimes send to senators) - NOT REALLY.

    If you poll most people with GCs and new Citizens who came through the EB route - i have a feeling that a large number would give the above answer in their truthful moments.
