I have requested for your valuable advise. But if you ask me why?No reason.... Why do we have many criminals? Why? Why? why? I believe every one is not perfect in any sense, some get caught, some not....

People get into these issues and keeps haunting them for years. I know a friend, who has a domestic violence record in 1999 or so and till date cant get a US citizenship because of that. Same with another guy who got a DUI in the 90s. Another guy in 2002, in order to bypass blocked traffic went to the other side (like they do in India often) and paid thousands to a lawyer to deal with the litigation with Police.

We booked a brand new house recently...after switching from consulting job to permanent job..I am on EAD
GC wait is endless ...kids are growing and don't want to raise them in rented apartments....paid 5% downpayment to have minimum risk...we procured couple of properties in India from our previous savings to fall back in case any unwanted situation in US

According to my thinking:
I would type the information related to the COPY OF EAD that you are sending now.
OR
I would type the information related to the EAD which is of most use to you.
Also dont only listen to people on this forum.
Call USCIS !!!
My original "Reciept notice" of 485 came from "California service Center" then few weeks i got another notice of action notice type = "Transfer Notice" that said your application has been transfered to "Nebraska service center".
For EAD renewal should i send copy of just Receipt Notice or both?
Also should i send the EAD renewal app to "Texas Service Center" as per instructions because i live in MA ?

Police certificate. All I did was to go to the Consulate in NY and get a police certificate. it was a one day job.can we at least get the facts please before the naysayers votes us down?

Looking at this scenario, it makes all the more sense to move to Canada.
Unless US starts skilled immigration, it is destined to become a 3rd world country. China would overtake it as the largest economy.
It is estimated that in about 20-30 years the worker:retiree ratio would be 2:1, thereby having a large tax on the employed.
There are lots of interesting articles on this subject.

They will retrogress all categories for India/China to 2001, so everyone will have to wait. Eventually people will fedup and leave the country (this solves half of their problem). For others they will keep issueing RFE for the next 5/10 years and enforcing stricter followup on AC-21 so people wont be able to leave their jobs and get promoted.
So who will want to continue working at programmer in their mid50s. Imp question is will there be a job for such candidate...and so they will move back.

My interpretation: the vote was not on Cornyn's amendment; in response to a Point of Order raised, there was a motion to waive the Budget Act for Cornyn's amendment (the Budget Act requires 60 "Yes" votes to bring to the floor amendments to appropriation bills); if 60 senators had voted "Yes" (and agreed to waive the Budget Act requirement for Cornyn's amendment), then a vote on the actual amendment would only have required a simple majority. But because only 55 voted "Yes", the amendment failed to obtain the waiver; it was out of order because it did not qualify as an amendment to this bill.
Because 40 Dems voted no on the waiver does not mean they are opposed to the amendment; they just did not want to vote on this amendment on this bill.

Can we do something in Indian regional news papers? I know http://www.eenadu.net or http://www.vaarttha.com/ two most popular online Telugu newspaper for skilled immigrants in US. Also www.idlebrain.com has popular enough which might help different group of people to know about what IV is doing.
It would be so great if our Chinese members told us more about this portal, and any others where we could get the word out.

Thanks SGP. Did I read this correctly ? you switched in 9th yr of h1 ? was ur I-485 pending or did u have EAD to change ? I just have I-140 approved. so if I change to a new job now, can the new employer use this old I-140 for extensions ? can new employer ask USCIS to port old priority date ?

It would be great to have premium processing for 485s instead now that visa nos are available. Now now ... i know thats wishful thinking but think about it-could save a lot of time and money over EAD/AP/FP renewals. But then again hurts their income stream thats why they wont do it :((
why would it hurt their income stream...when theyll charge u rpremium fees for fast 485 processing..it will be cash in teh bag in the first go rather than waiting over the years for EAD/AP renewals.

Guys MY PD is feb 2008. I am recently watching vias bulletins. I am in EB2.
Based on my watching previous visa bulletions ( after sep 2008) I dont see that it makes major difference if you file in EB3 or EB2.
Both are backloged very much and sincearly I dont hope inspite on being in EB2, I will get EAD or GC till 2015.
What are your thoughts, is it worth filing in EB2?

There is growing pessimism in EB community.
We have some rough plans for 2009.
We need to wait for some time to see how immigration bill becomes a priority. We anticipate some more placeholder bills that will make a statement. However in the end, there will have to be a bi-partisan effort and strong will to write a CIR. I feel economy will take priority initially but they will have to look at immigration sooner than later. Admin fixes is another possibility we see. While the EB2 India and China are now getting direct benefit from horizontal spillovers, in 2009 we need to meet again with the administration and make a good case about EB3 India, China and EB3ROW backlogs. The problem seems to be increasing due to limited visas per year. This is the reason dates have not been moving. Several Other small items for admin fixes are also in brainstorming stage. Like We want to address processing delays on all applications for all categories, do something to protect the rights of immigrants, etc.
We also want to involve more members who got their greencards or immigrants who are now citizens on IV. We want suggestions from members how we can do that and get their support for this cause.
I am sure with the new initiatives you will love Immigrationvoice more and want to come to IV everyday.
At your end, please try to spread the word about IV. We can be successful in all our initiatives only if we can get more participation. Thus we need to get more EB India, china and ROW members in the IV fold. This must be our top priority early this year before we launch our big campaigns.
We look to members reading this post to help us reach out to their friends and introduce IV to them. We have well meaning intentions for everyone in every category and country and want to help and bring relief. It is important that we come together on IV and make a united effort to end our common immigration problems.

Thanks for the reply , let me file the H1 transfer with Employer2 now in "Premium route" with the I-140 approval from Employer1 and see if we get a approval. Once i get a approval , i think stamping it wont be an issue after 7-8 months even thought Employer1 has revoked that I-140 ?
However i want to clear even if the Employer1 revokes this I-140 my PD still remains locked - right ???
This is not clear for retaining a priority date when I-140 is revoked. As per a US CIS memorandum, when I-140 is revoked for misrepresentation or fraud, person won't be able to carry the PD over. On the other hand, there are regulations that state that beneficiary would no longer be able to carry over the priority date in the event of I-140 being revoked.
Please note that the memorandum does not have the force of law.

Remember in life you have to have an attitude of respecting others, if u think you need to be treated specially cause you have lived in America 10yrs then u would be definitely disappointed. A lot of my friends have relocated to India and I am too early next year. The only answer is attitude.
But there are cases where you expect to be treated like a human , and you are not. That is the most difficult thing for some who returned and regret doing so.
And it is a bigger dream (than dream about getting GC) to expect people to leave en masse .

First your PD has to be current for USCIS to look into your RD.
Not quite, as I understand it, if your PD is not current, your AOS will continue processing and will eventually get to a "approved, pending visa number" state. You can pretty much be in this state for some time, and then when PD does become current (as happened from May through July this year with the significant shift in PDs in the bulletins) there will be a massive approval rate of all those pending applications.

This is how USCIS got through 60k unused visas in a staggeringly short time. There were a LOT of applications that were ready to go, they were just waiting for those numbers. USCIS didn't all of a suddenly quadruple their efficiency in processing :)
