Hello,
I got a notice today saying that my H1B withdrawal notice has been sent on Sep9th (today).
My new employer applied LCA yesterday (09.08.2009) for my H1B transfer.
What is my status now? can I transfer H1B to new company?
Is my old H1B revoked?
what is my next step to do to stay as legal immigrant?

All above dates are 2009. My L1 B (Individual) expired in February. So I am already around 3 months over my L1 status.

The battle for comprehensive immigration reform is going to be tough as Senate Republicans play politics with the critical immigration issue. The Senate passed its $44.3 billion fiscal 2010 Homeland Security appropriations measure 84-6 last week after three days of debate that differentiated the bill from its House companion on a handful of border security and immigration policies. Unfortunately Senate Republicans used the opportunity to add significant new provisions to the less controversial �extender provisions� including an extension to the Special Immigrant Nonminister Religious Worker Program and the Conrad Waiver Program for Physicians Serving in Underserved Areas. The Senate also included a provision promoted by AILA member Brent Renison to allow the foreign-born widows, children and parents of citizens who have died to retain their legal status to seek citizenship for two years after the death. Recently i changed my employer using AC 21.I received an RFE we replied for that.While this RFE in progress I changed my wife address to new and I didn't change.My employer attorney won't handle (represent) dependent applications.
Please help me.

1) Submit any secondary evidence in your possession to support the information you have provided about your marriage and claimed relation ship to Jwala Pogula, the principle applicant.
Secondary evidence will be evaluated for authenticity any credibility. Such evidence my take the form of historical evidence and must been issued contemporaneously with the event which it documents. Such evidence may include, but is not limited to: medical records, school records and religious documents.Affadivits may also be accepted provided that they are sworn to by persons who born at the time of and who have personal knowledge of to which to which they attest. Any affidavits must contain the affiant�s full name and address, date and place of birth, relation ship to the party on whose behalf they are attesting , If any complete details concerning how the affiant acquire knowledge of the event.
2) Explain why you leave at the following address( XYZ�.) and your spouse lives in ABC address.

Frankly I don't know why people think that IT folks cannot qualify for EB2. Inspite of all changes done by DOL, people with 4yr degree + 5 years of exp. can qualify for EB2. If the company can make a good business case and can prove that there are other people (Permanent Residents/ Citizens) in the organization with 4yr degree + 5 years of exp. for same/ similar position, there should not be any issue for the getting an EB2 approved. As far as my knowledge goes, the requirements are set forth in law - that is not something that USCIS can change over night.
True - it might become more difficult to get approval for such cases, but that does not mean that IT folks cannot qualify for EB2.

My wife is studying for Nursing and hence I know the anser. Either General Nursing or BSN will allow you to give the RN exam. However, before that have your crendtials evaluated by www.wes.org, so that an US equivalency is established. Based on that you can apply for the RN exam.
General Nursing is equivalent to an Associate in Nursing. For future promitions, BSN is better.

Please advise on this issue: I work for a engineering software company. Currently I work as a 'Technical Support Engineer', but my company has offered me a position of 'Sales Engineer'. I have already applied for my I-485, but have not received a notice yet. If I start working in the sales position, will this affect my GC application? Would the USCIS know about my change of duties, if my 'salary' and 'position title' remains the same? Please reply. Response will be highly appreciated!

Such half quotes cause more damage than do anything good for us. Maybe they picked up a few sentences rather than displaying the full context. I have not seen the full message. Looking at the quote and paragraph about 'Competing in the 21st Century Economy ' it seems like this argument is for more H1B visas and STEM exemption of H1B visas from its annual 65K quota.
Such messaging actually hurts us. Unless there is mention of 'Greencard' and 'backlog' such general statements would mean H1B to many.

Although Dphoto has a very active Canon forum, this site is about the image first. Gear at the higher levels is more a matter of personal preference. Nikon has some very strong points. For example ergonomically, the D2H is fantastic. What are the things that enticed you to choose Nikon?

I applied by mail to the DC embassy. I sent photocopies of everything and no problem.
The only thing to note though is that the DC embassy took a whole month to process my visa. I was going to Canada in September, applied in early july and received it somewhere in August. In the meanwhile when enquired about the status through email, they said they will delay it more now because I enquired. :) (and we think Indian govt. offices have bad attitude)
So I'd advise you to accomodate for the long time to get the Visa, if applying by mail.

My efiled EAD went to TSC. I sent my copy of my approved I140 and I485 as supporting documents. I got my biometric notice in a weeks time and in a month I got my EAD card. But I guess you need not send any supporting docs because you can give your I485 and I140 number in the online application itself.
